fa قواعد سپرده‌گذاری میکروارگانیسم‌ها در مراجع بین المللی سپرده‌گذاری (IDAs) با تاکید بر معاهده بوداپست تخصصي Special پژوهشي Research <div style="text-align: justify;"><span dir="RTL"><span style="font-family:B Lotus;"><span style="font-size:14.0pt;">میکروارگانیسم‌ها بخش قابل توجهی از تنوع زیستی را تشکیل می‌دهند و رشد اختراعات مربوط به میکروارگانیسم‌ها نشان‌دهنده اهمیت و کاربرد آنها در صنایع گوناگون با استفاده از زیست‌فناوری است. نگهداری میکروارگانیسم‌ها از دو منظر حفاظت از ذخایر ژنتیک و تنوع زیستی و شمولیت ضوابط حمایتی نظام حقوقی ثبت اختراع قابل بررسی است. در مواردی که اختراع در مورد یک میکروارگانیسم است، در برخی کشورها همانند ایالات متحده الزاماً استفاده از توصیف‌های مکتوب برای افشا کافی نیست و نیاز است تا یک نمونه از میکروارگانیسم نیز در مرجعی تخصصی سپرده شود. بر این اساس، سپرده‌گذاری میکروارگانیسم‌ها با هدف احراز جامع شرط افشا نظام ثبت اختراع مطابق مفاد معاهده بوداپست، به‌عنوان موضوعی جدی در سطح بین‌المللی به رسمیت شناخته شده است. در مقاله حاضر، با روش پژوهش‌های اسنادی و کتابخانه‌ای، ضمن تبیین گستره مفهومی واژه میکروارگانیسم در معاهده بوداپست، به بررسی و تحلیل قوانین حفظ، نگهداری و دسترسی به میکروارگانیسم‌ها در مراجع بین‌المللی سپرده‌گذاری بر پایه مفاد معاهده بوداپست پرداخته شده است. همچنین با بررسی چالش مجموعه‌های کشت ایران در پیوستن به معاهده بوداپست، نتیجه‌گیری شده است که حمایت‌های حقوقی و تکمیل زیرساخت‌های تخصصی، حلقه مفقوده مهم در حوزه حفاظت ذخایر ژنتیکی ایران و ثبت اختراع&nbsp;میکروارگانیسم‌ها است.</span></span></span></div> <div style="text-align: justify;">Microorganisms make a significant portion of biodiversity, and the growth of inventions related to microorganisms shows their importance for various industries, including biotechnology. Maintenance of microorganisms can be studied from two points of view in the framework of &ldquo;conservation of genetic resources and &ldquo;patent requirements&rdquo;. When an invention relates to a microorganism, in some countries, such as the United States, the written description is not necessarily sufficient to disclose the invention, and a sample of the microorganism needs to be submitted to a specialized center. In fact, the deposit of microorganisms for the purposes of patent procedures has also been recognized internationally by the Budapest Treaty. In the present article, based on the documentary and library research method, while delimitation of the scope of the term &ldquo;microorganism&rdquo; in the Budapest Treaty, the technical and legal rules for the conservation of microorganisms and biological materials in international depository authorities have been examinated according to the Budapest Treaty.
