Human cloning is one of the most recent scientific advancements that is poised to impact all aspects of human life and the future of the species. Cloning is considered a form of asexual reproduction. In human cloning, reproduction occurs without fertilization between male and female gametes. In this process, the genetic material within a female ovum is removed and replaced with the genetic material of a somatic cell from either a female or male donor. The possibility of producing a generation whose genetic traits and embryonic origin are determined by a single sex raises numerous global questions and presents multiple scientific and religious challenges. Scholars grapple on one hand with the ethical and social concerns involved, and on the other hand, the principle of prohibition (haram) emerges as a significant barrier to scientific research in this domain. Human cloning is an emerging jurisprudential issue that lacks explicit texts in the Qur'an or Hadith. However, its legal ruling can be derived from general principles and legal maxims of Islamic jurisprudence. This study elucidates the foundational principles of Imami jurisprudence and compares them with the perspectives of Sunni scholars, aiming to critically examine the jurisprudential arguments of both traditions.
